　Terms and Conditions

* The mare owner shall pay a stud fee of $750 to stallion owner after mare is confirmed in foal

via ultrasound by licensed veterinarian yet before mare leaves TPEF. Please contact TPEF for

further information regarding Thoroughbreds bred to race.

* Mare care of $13/day is to be paid to stallion owner before mare leaves TPEF. Mare care

includes; proper broodmare nutrition (free choice timothy/grass hay, grain twice/day,

turnout/stall time as decided according to weather (minimum 8 hours turnout/day weather

permitting), blanket changes and grooming as necessary. Other medical care such as,

but not limited to, farrier, de-worming, veterinary visits and a $400 foaling fee (if mare is to foal

at TPEF) are to be billed to mare owner and paid to TPEF or appropriate farrier/veterinarian

before mare leaves TPEF.

* A LFG (Live Foal Guarantee) is included with this breeding contract. A return season is

guaranteed so long as mare has a clean biopsy and culture before returning to TPEF to be

bred. Mare owner certifies that such abortion or death did not result by any act or omission by

the mare owner as per vet certificate. If the licensed veterinarian determines that the mare is

unsuitable for breeding, the mare owner may substitute a new mare subject to acceptance by

TPEF. The substitute mare will be under the same terms and conditions as the original mare.

* Mare owner shall return a copy of mares registration papers, current negative coggins and

vaccine history (Eastern/Western Encephalitis, Tetanus, Influenza, Rhino, Rabies, Potomac

are required) and health certificate (within the last 30 days) with this contract. Vaccines must

be administered at least 14 days prior to arrival at TPEF. Please deworm mare at least 30

days prior to arrival at TPEF. Mare should be in good general health upon arrival. This

contract is subject to acceptance of mare by TPEF.

* Mare owner assumes all responsibility for the condition of the mare and shall bear all risks

of loss or damage to the mare by death, injury, infection or otherwise, and by any cause

what-so-ever releases and holds harmless TPEF from any liability for any of the damages

associated therewith.

* If the stallion becomes unavailable without completing this contract the $750 stud fee will be

reimbursed to the mare owner.

* When the mare owner signs and returns this contract to TPEF, it will then be a binding

contract on both parties subject to the terms and conditions listed herein. If the contract is

breached, the breaching party will be responsible for the attorney fees and any court costs

incurred by the innocent party as a result of the breach.
